Central Government employees के लिए Modified Assured Career Progression Scheme यानी MACPS से जुड़ा एक महत्वपूर्ण विवाद इसकी effective date को लेकर था। सवाल यह था कि MACP का financial benefit 01 January 2006 से दिया जाए या Scheme में निर्धारित 01 September 2008 से।

विवाद क्या था?
MACP Scheme को Government ने 01.09.2008 से effective किया था। कुछ employees की ओर से यह मांग उठी कि Scheme का benefit 01.01.2006 से दिया जाना चाहिए।
इस मांग से जुड़े कई matters High Courts और Central Administrative Tribunals तक पहुंचे और बाद में Supreme Court के सामने भी similar issues आए। DoPT के 13.07.2021 OM में बताया गया है कि 01.09.2008 की effective date को 01.01.2006 तक prepon करने का issue कई cases में sub-judice था।
01.01.2006 वाली मांग का आधार क्या था?
इस विवाद में 6th Central Pay Commission के implementation से जुड़ी dates महत्वपूर्ण थीं।
DoPT के reproduced Supreme Court order के अनुसार, 6th CPC की recommendations को Government ने revised pay scales और Dearness Allowance के लिए 01.01.2006 से effective किया था।
इसी background में employees की ओर से यह argument सामने आया कि MACP financial benefits को भी 01.01.2006 से लागू किया जाना चाहिए।
Balbir Singh Turn case का क्या महत्व था?
Supreme Court के 28.04.2021 order में Balbir Singh Turn decision की चर्चा की गई।
उस case में Armed Forces Tribunal ने ACP benefit को pay structure से संबंधित माना था और 01.01.2006 की effective date के संदर्भ में employee claim को स्वीकार किया था। Supreme Court ने उस earlier case में Tribunal के finding को uphold किया था।
इसी वजह से बाद के MACP effective-date disputes में Balbir Singh Turn decision को एक महत्वपूर्ण precedent के रूप में refer किया गया।
M.V. Mohanan Nair case ने क्या बदला?
Supreme Court के reproduced order में M.V. Mohanan Nair judgment को विशेष महत्व दिया गया है।
इस case में तीन-Judge Bench ने ACP और MACP Schemes पर विचार करते हुए माना कि ये schemes stagnation से राहत देने वाली incentive schemes हैं।
Court ने यह भी माना कि MACP के तहत employee को next promotional post का Grade Pay नहीं, बल्कि applicable next Grade Pay का benefit मिलता है।
इसके साथ Court ने MACPS को Pay Commission recommendations के आधार पर बनाई गई Government policy के रूप में देखा और 01.01.2006 से MACP लागू करने की मांग को स्वीकार नहीं किया।
R.K. Sharma case में Supreme Court के सामने मुख्य प्रश्न
Union of India v. R.K. Sharma & Others में Supreme Court ने MACP की effective date को लेकर इसी background को examine किया।
Case Civil Appeal No. 1579/2021, arising out of SLP (C) No. 15572/2019 से संबंधित था।
Supreme Court का order 28 April 2021 का है, जिसे DoPT ने बाद में अपने 13.07.2021 OM के माध्यम से circulate किया।
Supreme Court ने 01.01.2006 की मांग पर क्या कहा?
Reproduced order में Supreme Court ने M.V. Mohanan Nair judgment को ध्यान में रखते हुए यह निष्कर्ष दर्ज किया कि employees को MACPS का benefit 01.01.2006 से claim नहीं किया जा सकता।
Court के reasoning में यह distinction महत्वपूर्ण रहा कि revised pay और DA के लिए 01.01.2006 की date होने का अर्थ यह नहीं था कि MACP financial upgradation भी उसी date से लागू हो जाएगी।
MACP की effective date 01.09.2008 क्यों मानी गई?
Supreme Court के reproduced order के अनुसार, allowances other than pay and DA सहित MACP-related financial upgradation को Government resolution के framework में 01.09.2008 से लागू किया गया।
Court ने इसी basis पर 01.01.2006 से MACP implementation की मांग को स्वीकार नहीं किया।
MACP को Pay का हिस्सा या Incentive Scheme क्यों माना गया?
Court ने ACP/MACP benefits को केवल normal pay structure के एक component की तरह treat करने के बजाय stagnation कम करने वाली incentive schemes के रूप में देखा।
यह distinction effective date के विवाद में महत्वपूर्ण था क्योंकि employees की तरफ से 01.01.2006 के revised pay structure से MACP benefit को जोड़ने की मांग की जा रही थी।
Supreme Court ने promotional hierarchy पर क्या कहा?
इस litigation का दूसरा महत्वपूर्ण aspect MACP का promotional hierarchy से संबंध भी था।
M.V. Mohanan Nair के संदर्भ में Supreme Court ने यह position discuss की कि MACP के तहत employee को next higher Grade Pay का benefit मिलेगा, न कि automatically next promotional post का Grade Pay।
इसका मतलब है कि:
MACP financial upgradation और
Regular Promotion
को अलग-अलग समझा जाना चाहिए।
01.01.2006 से MACP लागू करने का क्या प्रभाव होता?
Supreme Court के order में practical consequences पर भी विचार किया गया।
Court ने यह concern note किया कि यदि MACP को uniformly 01.01.2006 से implement किया गया और revised benefits दिए गए, तो कई cases में पहले किए गए excess payments की recovery का issue उठ सकता था, विशेषकर उन employees के संदर्भ में जो retire हो चुके थे।
Supreme Court ने High Court के judgment के बारे में क्या किया?
Order के अंतिम operative portion में Supreme Court ने संबंधित High Court judgment को set aside किया और Appeals को allow किया।
इसका direct effect यह था कि जिस basis पर 01.01.2006 से MACP benefit का claim किया जा रहा था, वह position Supreme Court के इस order के बाद कायम नहीं रही।
13 July 2021 के DoPT OM ने क्या किया?
Supreme Court order के बाद DoPT ने 13.07.2021 को Office Memorandum जारी किया।
इसमें सभी Ministries/Departments को कहा गया कि 01.01.2006 से MACP benefit मांगने वाली pending grievances को existing MACP guidelines और 28.04.2021 के Supreme Court order की रोशनी में dispose किया जाए।
साथ ही ऐसे court cases में, जहां judgments existing MACP policy के विपरीत हों, department को defence या appropriate appeal/action लेने की सलाह दी गई।
क्या 13.07.2021 का OM खुद Supreme Court judgment है?
नहीं।
यह distinction Government Document Repository में बहुत महत्वपूर्ण है।
28.04.2021 — Supreme Court का judicial order.
13.07.2021 — DoPT का administrative Office Memorandum, जिसमें Supreme Court order के relevant findings reproduce करके Ministries/Departments को action के लिए communicate किया गया।
इसलिए दोनों documents को एक ही प्रकार का document नहीं माना जाना चाहिए।

Employees के लिए इसका practical मतलब क्या है?
इस judicial development का मुख्य practical point यह है कि केवल 6th CPC की revised pay implementation date 01.01.2006 होने के आधार पर MACP को भी उसी date से लागू नहीं माना जा सकता।
MACP Scheme की अपनी effective date 01.09.2008 है, और 28.04.2021 के Supreme Court order को DoPT ने इसी position के समर्थन में circulate किया।
क्या 01.01.2006 से मिलने वाले अन्य pay benefits और MACP एक जैसे हैं?
नहीं।
यहीं सबसे अधिक confusion होता है।
6th CPC के revised pay scales और DA की implementation अलग issue है।
MACP एक अलग financial upgradation scheme है, जिसकी effective date Government द्वारा अलग से तय की गई थी।
Supreme Court ने इसी distinction को effective-date dispute में महत्वपूर्ण माना।
MACP Effective Date और Next Grade Pay—दो अलग मुद्दे
इस पूरे litigation को समझने के लिए दो questions को अलग रखें:
Question 1 — MACP कब से effective है?
इस विवाद में Supreme Court के 28.04.2021 order और DoPT OM के अनुसार relevant date 01.09.2008 है।
Question 2 — MACP में कितना financial upgradation मिलेगा?
इसका संबंध applicable MACP rules में prescribed next higher Grade Pay/Pay Level से है, न कि automatically next promotional post से।
इसलिए “01.01.2006” और “next promotional Grade Pay” को एक ही issue समझना सही नहीं है।
Supreme Court Order का मुख्य takeaway
28 April 2021 के order से जुड़े प्रमुख points को इस तरह समझा जा सकता है:
MACP की effective date को 01.09.2008 से 01.01.2006 तक prepon करने की मांग स्वीकार नहीं की गई।
M.V. Mohanan Nair की interpretation को महत्वपूर्ण आधार माना गया।
MACP को stagnation relief देने वाली incentive scheme के रूप में देखा गया।
MACP financial upgradation और regular promotion को अलग रखा गया।
01.01.2006 से uniform MACP implementation से excess payment और recovery जैसे practical issues भी Court के विचार में आए।
निष्कर्ष
28 April 2021 का Supreme Court order MACP की effective date को लेकर चले लंबे विवाद में एक महत्वपूर्ण judicial development है।
Supreme Court ने Union of India v. R.K. Sharma & Others में M.V. Mohanan Nair की reasoning को ध्यान में रखते हुए 01.01.2006 से MACP benefit लागू करने की मांग को स्वीकार नहीं किया। Court ने MACP को एक incentive/financial upgradation scheme के रूप में देखा और Scheme की निर्धारित effective date के framework को बनाए रखा।
इसके बाद DoPT ने 13 July 2021 को Office Memorandum जारी करके Ministries/Departments को 01.01.2006 से MACP benefit मांगने वाली grievances और संबंधित court cases पर Supreme Court order तथा existing MACP guidelines के अनुसार कार्रवाई करने की सलाह दी।
